[edit] Additional IP Rights Grant
"You" means any person or Legal Entity on behalf of whom this Implementation has been received.
"Legal Entity" means an entity which is not a natural person.
"Affiliates" means other Legal Entities that control, are controlled by, or under common control with that Legal Entity. For the purposes of this definition, "control" means (i) the power, direct or indirect, to cause the direction or management of such Legal Entity, whether by contract or otherwise, (ii) ownership of fifty percent (50%) or more of the outstanding shares or securities which vote to elect the management or other persons who direct such Legal Entity or (iii) beneficial ownership of such entity.
“The Project” means the packages of source code, binary executables and other data published by Overte and received by You via download .
"This Implementation" means the version of the Project that You accept via download from Overte.
Overte hereby grants to You a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in this section) sub-license, with the right to grant multiple levels of sub-licenses, to any and all sub-licensable patent rights obtained by Overte to make, have made, use, offer to sell, sell, import, transfer, and otherwise run, modify and propagate this Implementation. The rights granted to You under this sub-license any and all rights to make, use, and/or sell patented inventions for which Overte has obtained a right to sub-license. If You or your agent or exclusive licensee institute or order or grant consent to the institution of patent litigation against any entity (including a cross-claim or counterclaim in a lawsuit) alleging that any unmodified code incorporated within this Implementation constitutes direct or contributory patent infringement, or inducement of patent infringement, then any patent rights granted to you under this License shall terminate as of the date such litigation is filed.
